The Sale of Alcoholic Beverages

DryFarmWines.com does not sell alcohol to persons under the age of 21. By using this site you swear and affirm that you are over the age of 21. DryFarmWines.com makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 21. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from DryFarmWines.com is over the age of 21. You also agree that any alcohol purchased from DryFarmWines.com is intended for personal consumption and not for resale. If you do not agree with these conditions of use please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21 DryFarmWines.com will prosecute you fully to the extent allowable by law. We require a signature of someone over the age of 21 to accept the wine package upon delivery.

Title and Ownership

Title to, and ownership of, all wine passes from DryFarmWines.com to the purchaser at the warehouse and state it is purchased in and the purchaser takes all responsibility for the shipping from the warehouse to his/her home state. By arranging for transportation of the wine, DryFarmWines.com is providing a service to, and acting on behalf of the purchaser. By utilizing this service from DryFarmWines.com, the purchaser is representing that he/she is acting in a fashion compliant with his/her local and state laws regarding the purchase, transportation and delivery of wine. The purchaser represents that he/she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine and is legally entitled to take quantities ordered and once again authorizes that he/she is 21 years of age.

Force Majeure

You agree to submit to the jurisdiction of the courts located in Napa County, in the State of California, for the resolution of all disputes arising from or related to these Terms of Service and/or your use of the Site.

Shipping Regulations – Where does DryFarmWines.com ship wine?

Due to the restrictions of many state laws, we only ship wine to those states where direct shipment is permitted by law. At the present time, we can ship to: AL, AR, AZ, CA, CO, CT, DC, DE, FL, GA, IA, ID, IL, IN, KS, KY, LA, MA, MD, ME, MI, MN, MO, MS, MT, NC, NE, NH, NJ, NM, NV, NY, OH, OK, OR, PA, RI, SC, SD, TN, TX, VA, VT, WA, WI, WV, WY

All packages are shipped using UPS and Federal Express (where available) and our shipping prices include packaging materials. You will be notified by email when your wines are shipped. Generally, we will attempt to ship your wines shortly after your order is placed. However, in effort to protect your wine, please be aware that your order may be held for ideal weather and shipping conditions.

Please note, by law; that there must be someone over the age of 21 to sign for your package when it arrives. We recommend that you ship to an office or place of business where packages can be easily signed for. We appreciate your understanding.

Due to ever changing direct-shipping laws and regulations, the list of states that we ship to may change at any time. All wines are sold in California and title passes to the buyer in California. We will arrange for shipment on behalf of the buyer, to an address specified by the buyer, provided that in our sole discretion we believe that such shipment will not subject us to the risk of any sort of legal action or other harm. If a buyer lives in a state where the direct shipment of wine may violate the law, we will contact the buyer to discuss shipping options, which options may include provision of an alternative shipping address in a state where the direct shipment of wines to consumers is permitted or storage of the wines at an acceptable third-party storage facility.

Selecting Delivery Dates

Generally wine will ship at approximately the same time each month as your original order. If you need to change this please call or email and we will adjust.

Returns

We are ridiculously committed to your happiness as our friend and customer.  We stand behind every product and service experience you have with us.

If you ever receive a product from us you don’t like, return the empty bottle (yes you drink the wine) and we will refund you or ship you another bottle, you choose.  Plus, we will even pay all the shipping!
